RESUMO: A Seção n. 232 do Ato de Expansão do Comércio de 1962 dos Estados Unidos autoriza a restrição de importações para a proteção da segurança nacional. Exemplo da incidência da norma está na elevação das tarifas de importação de aço e alumínio em 2018, reiteradas em 2020, pelo Departamento de Comércio (USDoC) dos EUA. Ao se revisitar a literatura sobre o tema, e tendo-se como paradigma o precedente “Rússia – Medidas relativas ao tráfico em trânsito” da Organização Mundial do Comércio (OMC), o presente artigo realiza o cotejo jurídico da Seção n. 232 com a exceção de segurança nacional prevista no art. XXI do Acordo Geral sobre Tarifas e Comércio (GATT-94). Em consonância com a revisão realizada, corrobora-se a interpretação provável acerca da incompatibilidade da Seção 232 com a normativa da OMC.
